These Terms of Service ("Terms") govern your access to and use of www.royaloudfragrances.ca ("Website"), operated by Royal Oud Fragrances ("Royal Oud Fragrances," "we," "us," or "our"), and the purchase of any products ("Products") through the Website or at our retail location in Windsor, Ontario. By accessing the Website, placing an order, or making a purchase, the customer ("Customer," "you," or "your") agrees to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or purchase our Products.

1. Eligibility

1.1 By using the Website, you represent that you are at least the age of majority in your province or territory of residence, or that you are using the Website under the supervision of a parent or legal guardian.

1.2 The Website and our Products are intended for customers located in Canada. We do not accept or fulfill orders with shipping addresses outside of Canada.

2. Our Products

2.1 Royal Oud Fragrances sells fragrance dupes — original fragrance products crafted to closely resemble the scent profiles of popular designer and niche perfumes. All Products are manufactured, labelled, and sold under the Royal Oud Fragrances name.

2.2 Royal Oud Fragrances is an independent business. We are not affiliated with, endorsed by, sponsored by, or associated with any of the original brands, designers, or fragrance houses whose scents inspire our Products. Any brand names or trademarks referenced on the Website are the property of their respective owners and are used solely for the purpose of describing and comparing scent profiles.

2.3 While our Products are formulated to closely resemble their inspiration scents, we make no guarantee that any Product will be identical to the original fragrance in scent, longevity, projection, or performance. Individual perception of fragrance varies from person to person.

2.4 Product descriptions, images, and scent notes on the Website are provided for general information only. We make reasonable efforts to display Products accurately, but we do not warrant that descriptions, colours, or images are error-free, complete, or current.

3. Health and Safety Notice

3.1 Fragrance products contain concentrated aromatic compounds, alcohol, and other ingredients that may cause allergic reactions or skin sensitivity in some individuals.

3.2 Customers with known allergies or sensitive skin should review the ingredient information where available and perform a patch test before regular use. Discontinue use immediately if irritation occurs and consult a medical professional if symptoms persist.

3.3 All Products are intended for external cosmetic use only. Keep out of reach of children and away from open flames, heat sources, eyes, and broken skin.

4. Orders and Payment

4.1 By placing an order, you make an offer to purchase the selected Products subject to these Terms. All orders are subject to acceptance and availability. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear fraudulent, are placed in bulk quantities suggestive of resale, or contain pricing or listing errors.

4.2 You agree to provide current, complete, and accurate purchase and account information for all orders. It is your responsibility to ensure that billing, shipping, and contact details are correct prior to checkout.

4.3 Payment is due in full at the time of purchase. We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided.

4.4 If an order is cancelled by us after payment has been processed, a full refund will be issued to the original payment method.

5. Pricing

5.1 All prices are listed in Canadian dollars (CAD) unless otherwise stated and are exclusive of applicable taxes, which will be calculated and displayed at checkout.

5.2 Prices, Products, and promotional offers are subject to change at any time without notice. Promotions cannot be applied retroactively to previous purchases.

5.3 In the event of a pricing error on the Website, we reserve the right to cancel any order placed at the incorrect price, whether or not the order has been confirmed, and to issue a full refund of any amount paid.

6. Shipping and Delivery

6.1 Shipping is available within Canada only. All shipments are governed by our Shipping Policy, which is incorporated into these Terms by reference and available on the Website.

6.2 Risk of loss and title for Products purchased online pass to you upon our delivery of the Products to the shipping carrier, subject to the terms of our Shipping Policy.

7. Returns, Refunds, and Exchanges

7.1 Returns, refunds, and exchanges are governed by our Return Policy, as posted on the Website and incorporated into these Terms by reference.

7.2 For hygiene and safety reasons, we reserve the right to refuse returns of opened or used fragrance products except where required by applicable law or where the Product is defective.

7.3 Nothing in these Terms limits any rights or remedies you may have under applicable Canadian consumer protection legislation, including the Consumer Protection Act, 2002 (Ontario), where such rights cannot be waived or limited by contract.

8. In-Store Purchases

8.1 These Terms apply to purchases made at our retail location in Windsor, Ontario, to the extent applicable, together with any policies posted in store.

8.2 In-store promotions, pricing, and availability may differ from those offered on the Website.

9. Intellectual Property

9.1 All content on the Website — including text, graphics, logos, images, product names, and layout — is the property of Royal Oud Fragrances or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

9.2 You may not reproduce, distribute, modify, republish, or otherwise use any content from the Website for commercial purposes without our prior written consent.

9.3 Third-party brand names and trademarks referenced on the Website remain the property of their respective owners. No license or right to use such trademarks is granted or implied.

19.1 These Terms, together with the Shipping Policy, Return Policy, Privacy Policy, and any other policies posted on the Website, constitute the entire agreement between you and Royal Oud Fragrances with respect to your use of the Website and purchase of Products, and supersede any prior agreements or understandings.
